Das Nagoya-Protokoll – Auswirkungen auf die Pflanzenzüchtung

Abstract

Zur Ermöglichung geregelten Zugangs von Forschern und Entwicklern zu genetischen Ressourcen und zur Eindämmung der Biopiraterie ist im Jahre 2010 das „Protokoll von Nagoya über den Zugang zu genetischen Ressourcen und die ausgewogene und gerechte Aufteilung der sich aus ihrer Nutzung ergebenden Vorteile zum Übereinkommen über die biologische Vielfalt“ (Nagoya-Protokoll) verabschiedet worden. Der Beitrag soll die wesentlichen Eckpunkte in der Entstehung und Umsetzung des Nagoya-Protokolls erörtern und die Folgen für die Pflanzenzüchtung aufzeigen. Probleme resultieren insbesondere aus der Tatsache, dass alles bei der Züchtung verwendete Material bis hin zum Endprodukt als genetische Ressource anzusehen ist.

The Nagoya Protocol – consequences for plant breeding

For the enablement of structured access for researchers and developers to plant genetic resources and for the containment of biopiracy in the year 2010 the “Nagoya Protocol on access to genetic resources and the fair and equitable sharing of benefits arising from their utilization to the Convention on Biological Diversity” (Nagoya Protocol) was adopted. The article shall discuss the main cornerstones in the genesis and implementation of the Nagoya Protocol and highlight the consequences for the plant breeding industry. Problems result especially from the fact, that all material which is used in plant breeding up to the final product is to be regarded as genetic resource.
